These Terms of Use (“Terms”) govern your use of the Kidy View application (“the app”) provided by Emfox Studio OÜ (“we,” “us,” or “our”). By downloading or using Kidy View, you (the user or the parent/guardian of a minor user) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.

Kidy View is designed as a children-friendly app that lets users view photos and videos stored on their own device in a safe and simple way. We recommend that children use this app under adult supervision. The adults (parents or guardians) are responsible for explaining these Terms to any minors using the app and ensuring they are followed.

Please read these Terms carefully. We have tried to write them in clear and simple language while covering important legal points to protect both you and us.

License to Use the App

We grant you a personal, non-exclusive, non-transferable, limited license to use Kidy View on devices that you own or control, for personal and non-commercial purposes. This means:

You may use the app to view and enjoy your own device’s photos and videos.
You cannot resell, distribute, or make the app available on a network where it could be used by multiple users at the same time.
You cannot copy, decompile, reverse engineer, or attempt to extract the source code of the app, unless laws prohibit those restrictions or you have our written permission.
This license is provided to you as long as you follow these Terms and any usage rules from Apple App Store or Google Play (depending on your device). If you violate these Terms, we can terminate your right to use the app.

All rights not expressly granted to you are reserved by Emfox Studio OÜ. The app is licensed, not sold, to you. You obtain no ownership of the app or its code by using it.

User Responsibilities and Appropriate Use

Kidy View is intended for use by children with guidance from adults. By using the app, you agree to the following responsibilities and proper use guidelines:

Parental Supervision: If you are a parent or guardian allowing your child to use Kidy View, you are responsible for supervising the child’s use of the app. This includes managing what content on the device the child can access and overseeing any in-app purchases or settings changes.
Appropriate Content: Kidy View itself does not provide content; it displays what is on your device. Ensure that any photos or videos accessible to the child through the app are appropriate for the child’s age. We are not responsible for any content that resides on your device.
No Illegal Use: You agree not to use the app for any unlawful or prohibited purpose. For example, do not use it to display or share illicit images or to infringe on others’ rights.
No Harmful Behavior: You will not attempt to damage, disrupt, or interfere with the app’s proper working. This includes not introducing viruses, exploiting vulnerabilities, or trying to access areas of the app or service that you are not allowed to access.

In-App Purchases and Subscriptions

Kidy View offers an optional premium subscription to unlock additional features. The following terms apply to subscriptions and in-app purchases:

Subscription Provider: All subscriptions are handled through the Apple App Store (using your Apple ID account). If the app is available on Google Play, similar rules apply via your Google Account. We use RevenueCat as a service to manage and validate subscription status.
Payment and Renewal: When you subscribe, your payment will be charged by Apple (or Google, if applicable) to your account. Subscriptions are typically auto-renewing, meaning they will renew at the end of each billing cycle (such as monthly or annually) unless you cancel. Apple may charge your account within 24 hours prior to the end of the current period.
Managing Subscriptions: You can manage or cancel the Kidy View subscription at any time via your App Store account settings. For example, on iOS, go to your device’s Settings > [Your Name] > Subscriptions to view or cancel. If on Google Play, go to Google Play Store > Subscriptions. We (Emfox Studio OÜ) cannot cancel subscriptions for you; it must be done by the user through the platform.
Free Trial and Cancellation: If a free trial is offered, it will automatically convert to a paid subscription if not canceled before the trial ends. Once you cancel, you will continue to have access to the premium features for the remainder of the paid period. No further charges will occur after cancellation, but no refunds are provided for the unused portion of the term except as provided by the App Store or required by law.
Multiple Devices: If you use Kidy View on multiple devices with the same App Store account, your subscription should grant premium access on all those devices (subject to proper restore purchase functionality). Use the “Restore Purchase” option in the app if needed to apply an existing subscription to a new device.
No Other Purchases or Ads: Aside from the subscription, there are no other in-app purchases. The app contains no third-party advertisements, so you will not be prompted to buy unrelated products or see ads.

By making an in-app purchase, you also agree to comply with Apple’s media services terms (or Google Play terms for purchases) as these transactions are facilitated through those platforms.

Parental Gate and External Links

To protect children, Kidy View has a parental gate (an adults-only restricted section). Only adults (parents/guardians) should pass this gate. The gate may require answering a math question, entering a birth year, or using a device passcode—some method to verify an adult is present.

Within this adult section, you can access:

External Links: Links to our Privacy Policy, Terms of Use, support page, or other informational content. These links will open in your device’s default web browser.
Settings or Purchases: Options to manage the subscription or app settings that should be handled by adults.

By using the parental gate, you confirm you are an adult or have guardian permission. Do not disclose the parental gate answer or method to children, to ensure they cannot accidentally leave the app or access unintended content.

We are not responsible if a child bypasses the parental gate without permission. We have made it suitably challenging for a child, but parents/guardians should still monitor device use. When following an external link from the app (even though it might just show our policies), remember that you are then using an external web browser. We strive to ensure any external content we link is safe and appropriate. We do not link to third-party sites beyond our control except our own website pages.

Intellectual Property

All intellectual property rights in and to Kidy View (including but not limited to the app’s software, design, and branding) are owned by Emfox Studio OÜ or our licensors. These rights are protected by copyright, trademark, and other applicable laws.

Emfox Studio OÜ Trademarks: “Kidy View” and any associated logos or graphics are trademarks of Emfox Studio OÜ. You are not permitted to use these without our prior written consent, except as necessary for you to use the app in accordance with these Terms (for instance, mentioning the app’s name while legitimately reviewing it).
User Content: Kidy View does not create or host content; it displays content (photos/videos) from your device. We claim no rights over your personal photos or videos. Those remain your property. By using the app to view them, you are not transferring any ownership to us. We simply have the technical ability to display them for you within the app.
Restrictions: You may not remove or obscure any copyright, trademark, or other proprietary notices within the app. Also, do not use our intellectual property (like the app’s name or code) to make derivative products, unless expressly allowed by us in writing.

Disclaimers of Warranties

We strive to make Kidy View reliable and enjoyable, but there are some things we need to disclaim legally.

Kidy View is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the app, including but not limited to:

Fitness for a Particular Purpose: We do not guarantee that Kidy View is fit for your specific needs, though we designed it for viewing device media for children.
Non-Infringement: We do not warrant that the app will not infringe on third-party rights (though we have no reason to believe it does).
Error-Free or Uninterrupted Use: We do not guarantee that Kidy View will always be available, uninterrupted, or error-free. For example, the app might have occasional bugs, or there could be downtime for updates.
Device Compatibility: We ensure the app runs on supported devices (per App Store listings), but we don’t warrant performance on jailbroken or significantly outdated devices.
Data Loss: While using the app should not delete or modify your photos/videos, we are not responsible for any accidental loss or damage to your media. It’s always wise to keep backups of important photos/videos elsewhere.

Use of the app is at your own risk. For example, if you allow a child to use the app unsupervised and they manage to delete a photo or subscribe unintentionally, the responsibility lies with the user/parent, not Emfox Studio OÜ. We provide tools (like parental gates and confirmations) to help prevent mistakes, but we cannot guarantee they’re foolproof.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. In such cases, our warranties are limited to the minimum permitted by applicable law.

Limitation of Liability

To the maximum extent permitted by law, Emfox Studio OÜ shall not be liable for any damages arising out of or related to your use or inability to use Kidy View. This includes:

Direct, Indirect, or Consequential Damages: We won’t be liable for losses like lost profits, lost data, business interruption, or personal injuries, even if caused by using or misusing the app. For example, if using the app somehow causes your device to malfunction (unlikely) or you miss capturing a photo opportunity, we are not responsible for those damages.
In-App Purchase Issues: Any billing or financial issues related to subscriptions should be resolved with the App Store or according to their refund policies. Our liability for any subscription-related claim is limited as we do not directly handle the billing.
External Links or Third-Party Services: If you follow an external link from the app (to view our policies or otherwise) or use third-party services like Apple or RevenueCat through the app, we are not liable for content or issues that arise from those external sites/services. We do vet our own links and services carefully, but we cannot control external providers.

In any case, our total liability to you for all claims arising from use of the app will not exceed the amount you may have paid to us (which, in most cases, would be the subscription fee, if any). If you only use the free version, our liability would be zero since you paid nothing.

Exceptions: Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law. For instance, if law in your region does not allow excluding liability for personal injury or fraud, we do not exclude that liability.

By using the app, you understand and agree to this limitation of liability. If you disagree, please do not use Kidy View.

Termination

These Terms are effective until terminated by either party. You may terminate them at any time by simply discontinuing use of Kidy View and uninstalling the app from your devices.

We may terminate or suspend your access to the app, with or without notice, if you violate any provision of these Terms or if we decide to discontinue the app. Upon termination:

The rights and licenses granted to you will end. You must stop using the app and uninstall it.
Provisions of these Terms which by their nature should survive termination (such as Disclaimers of Warranties, Limitation of Liability, and Governing Law) will continue to apply.
If we terminate service of the app entirely, we will try to notify users in advance via an app notice or through the app stores. Any subscriptions would be handled appropriately (for example, ending auto-renewals). If the service ends before a paid subscription period lapses, we would coordinate with the App Store for possible pro-rated refunds as required.

Changes to These Terms

We may update or modify these Terms of Use from time to time. Reasons for changes may include adding new features, clarifying terms, or ensuring compliance with laws and app store policies.

If changes are minor or clarifying, we may update the Terms in the app (in the parental section) and update the “Last Updated” date.
If changes are significant (for example, changing the nature of the app or adding any data collection), we will provide a more prominent notice, such as a pop-up notification in the app or a requirement to accept the new terms.

Governing Law and Jurisdiction
